A one-time community activist and candidate for Erie mayor, convicted of raping a child, got his sentence overturned Tuesday.

35 year old Rubin Swift, was sentenced to 28 to 60 years last February, after pleading no contest to charges, of raping an 11 year old girl.

He was involved in a number of community activism campaigns.
You may remember, at one point he tried to walk to Washington DC, to protest high gas prices.
He ran for Erie mayor, in 2005.

Swift got a new trial because forensic nurse, Rhonda Henderson, presented key evidence in his case. Her work has since been called into question.

It took a jury took 2 hours Tuesday morning, to acquit Swift of child sexual assault charges.
He's still facing kidnapping charges in Ohio, in a separate case. In that case, police say,he robbed and kidnapped drug dealers, on the streets of Cleveland.
