The Pennsylvania Democratic Party on Thursday filed a lawsuit against the Erie County Board of Elections over numerous issues related to mail-in voting due to one of its vendors.

The lawsuit claims 10,000 to 20,000 voters who requested mail-in ballots have not received or submitted their ballots and more than 300 voters are believed to have received two mail-in ballots, one of which may not reflect a voter's local races.

The Democratic Party said the "issues have caused registered voters substantial delays and hardships and could possible violate the right to vote."

It also accuses the Board of Elections of not properly addressing these issues with the election less than a week away. The lawsuit also said the Board of Elections is "apparently providing inaccurate information to voters of their options and failing to take appropriate action to remedy a significant breakdown in operations."

The Pennsylvania Democratic Party is asking for an injunction to:

  1. provide a list of affected voters to the Democratic Party;
  2. produce any correspondence or guidance that was sent to affected voters;
  3. provide options to make sure affected voters are able to cast a correct ballot in a timely manner;
  4. provide any other remedies to properly comply with the Election Code.
