Inspection Summary: Staff Unable to Find Smoke Detectors Prior to Fatal Day Care Fire
Nearly five weeks after five children were killed in the Harris Family Daycare fire, Erie News Now has learned the facility has been cited more than 100 times, since 2013.
Through the work of Senator Dan Laughlin's office, Erie News Now has obtained copies of 16 inspection reports conducted at the day care, over the past six years.
During a 2016 inspection, one report says staff members were unable to locate fire extinguishers or smoke alarms.
The issue was listed as corrected, with no further details.
However, in 2017, the Department of Human Services cited the day care for not having an emergency plan, after the day care operator told inspectors they did not have one.
"There's a big difference between conducting inspections and correcting mistakes,” said attorney John Carlson. “I think that's where the focus needs to be, on correcting."
Carlson is representing the family of two-year-old Dalvin Pacley, who was killed in the fire.
Carlson is exploring any potential legal action.
"We're looking at everything right now,” said Carlson. “We're still primarily focused on the cause and origin of the fire and once we are able to determine that, then we will be able to more clearly assess the next step."
Meanwhile, in a recent visit, DHS Secretary Teresa Miller said her department will work with local agencies, to ensure safety at day care facilities across the state.
